Terms and Conditions

Thank you for choosing to stay with us at Heddwch. We hope you enjoy your stay. Please find below the terms and conditions applicable to the property. Please read them carefully as by booking and paying for a holiday you are deemed to have accepted them.
We advise that you take out insurance to ensure that, should you need to change or cancel your holiday, you can recover the associated costs from your insurance provider.
Heddwch is managed by Llainfran Holidays. All contractual agreements in respect of your booking are made with Llainfran Holidays. References to ‘we’, ‘us’ and ‘our’ in these terms and conditions are to Llainfran Holidays and its owners. References to ‘you’, ‘your’ and ‘guest’ in these terms and conditions are to you, as the person making this booking and, where applicable, to every member of your party.

1. YOUR BOOKING

These Terms and Conditions apply to all bookings made directly with Llainfran Holidays or our selected agents. All offers, and bookings are subject to availability. The person making the booking will be deemed to be the party leader and must be 18 years of age or over at the time of booking. This person will be responsible for the conduct of the rest of the party, and for all other aspects of the booking including paying all balances due and paying for any damage to the property or its contents.
Only those guests listed and named during the booking process may occupy the property unless specifically agreed otherwise with us at least 7 days prior to arrival. Occupancy must not exceed the maximum number of people as
stated in the property description.
The property must not be used for any commercial or formal business purpose (other than remote office or virtual working via internet connection).

2. PAYMENT

We accept a booking, upon receipt of a non-refundable 30% deposit. You will receive confirmation of your booking by email, showing your booking details and balance of your holiday cost. When you receive your confirmation, you must check all details and inform us immediately if anything is incorrect.

The balance is payable and must be received by us no later than 6 weeks before arrival date. If we do not receive the balance by the specified date in your confirmation letter, we reserve the right to consider the booking cancelled by you, and we may endeavour to re-let the cottage.
Please see Condition 7 below.
For bookings made within 6 weeks of arrival, the whole amount, including damages deposit (see 3 below) is due at time of booking.
Payment can be made by bank transfer, by cheque payable to ‘Llainfran Holidays’ and sent to Llainfran Fach, Nanternis, New Quay SA45 9RR, debit or credit card.

3. DAMAGES DEPOSIT

A refundable damages deposit of £200.00 is payable with your final payment no later than 6 weeks before arrival date. This is held in a separate deposit account and refunded within 7 days of your departure minus any damages or excessive cleaning costs including rubbish/waste removal (if applicable).

4. PAYMENT METHOD

We accept payment by bank transfer, cheque and all major credit and debit cards except American Express.

5. CORPORATE BOOKINGS, STAG AND HEN PARITIES

Any corporate or business bookings must be declared and specifically agreed with us prior to the booking being confirmed. Stag or Hen parties will not be accepted at any time.

6. INSURANCE

We have all necessary third party and public liability insurance on the property. However, your personal and travel insurance is NOT included, and we strongly advise you take out your own personal travel and cancellation insurance for any eventuality that may occur including pandemics.

7. CANCELLATION POLICY

All cancellations must be notified by email.

If WE have to cancel your booking:
We will endeavour to honour your holiday booking as booked, however, if we are unable to do so, for any circumstances beyond our control, including any reason of force majeure or a need to follow government regulations or requirements, we will in the first instance, look to transfer your booking to another date by mutual agreement with no additional booking fee. If an alternative date cannot be agreed, we will refund all payments. Our liability for cancellation will be limited solely to payments made to Llainfran Holidays.
If YOU have to cancel your booking:
If you unfortunately need to cancel, your deposit payment is non-refundable.

Balance payments are also non-refundable unless we can re-let the property.
Where we can re-let, an administration fee of £30 and any commission paid to a third party, and any other expenses incurred in re-letting the cottage including the price difference if the cottage is re-let at a reduced rate, will be deducted from any refund.
If you need to cut short your holiday/break after it has commenced, we regret that we are unable to refund any monies paid.
Llainfran Holidays strongly recommend that you take out comprehensive travel and holiday cancellation insurance to protect against unforeseen circumstances. If you choose not to, then you accept responsibility for any loss that you may incur due to your cancellation.

8. PERIOD OF HIRE

The property will be ready by 4pm on the day of arrival and must be vacated no later than 11am on the agreed day of departure. The minimum hire period is 3 nights, with options for 4 or 7 nights. Maximum
hire period is 28days. Guests will be advised on arrangements for key collection and deposit. If your departure extends beyond the check-out time of 11am without our prior agreement, we reserve the right to deduct a late departure charge of £30 from your deposit up to the sum of £50 per hour unless otherwise previously agreed
with us.

9. HEALTH AND SAFETY

Llainfran Holidays take the wellbeing and safety of our guests seriously. Therefore, we would ask that you comply with the following:
The number of persons occupying the property must not exceed the maximum number stipulated and agreed at the time of booking. We reserve the right to terminate the hire without notice if this condition is breached.
We ask that any guest who is not self-caring is not left alone on the property.
Other visiting guests are welcome to visit but must not stay overnight unless previously agreed with us. We ask to be advised of visiting guests beforehand.

10. YOUR RESPONSIBILITIES AND CARE OF PROPERTY

The property is strictly non-smoking in all rooms, terrace, garden and drive. This is to safeguard the property and the amenity of our neighbours. Anyone found to have been smoking or vaping in the accommodation will be
charged a fee of up to £250 for a thorough clean to be carried out by a contractor.

We are entitled at our absolute discretion to refuse to hand over to you, or epossess, the property, if we believe that smoking is/has occurred inside the cottage, any damage is likely to be caused, has been caused or is being caused by any members of your holiday party. These circumstances will be treated as a cancellation by you. In this instance, you must vacate the cottage, and no efund will be given, and we shall have no liability to you.
The unlawful use of any drugs and substances by you during your stay will be treated as a cancellation by you as stated in the paragraph above. You are required not to cause any nuisance or upheaval to any other guests or staff of Llainfran Holidays. We promote Heddwch as a peaceful holiday location. We require guests not to create excessive noise or disturbance during their stay, or to cause nuisance to any neighbours.
We ask that Heddwch is left clean and tidy on departure and ready for the next guests. No confetti, glitter or similar material is allowed either inside or outside the property. Nothing should be stuck to the doors, walls or windows in the property.
We reserve the right to make an additional charge for the extra costs of cleaning incurred if the property is not left in a satisfactory condition. Guests must not under any circumstances flush non-organic materials such as
nappies, sanitary towels, wet wipes, cotton buds or any other personal hygiene items into the drainage system. We reserve the right to withhold some, or all the deposit monies held to pay for the unblocking of drains where guests have failed to comply with the above requirements.
To comply with Welsh Government policy, guests are required to manage and recycle waste responsibly throughout their stay using the bins and bags supplied, all in accordance with the instructions for segregating kitchen and other waste provided to you on your arrival. We reserve the right to withhold part of the deposit monies held where guests fail to comply with the stated recycling requirements.
When you leave the property unoccupied, please lock all the doors and close all the windows. Please also make sure you switch off lights and any electrical appliances before you go out.
You must allow us the owners, or our representatives access to the property at any reasonable time.
Under no circumstances is Heddwch to be relet or sublet even free of charge.

11. SPECIALIST EQUIPMENT CAPABILITIES AND LIMITATIONS

Heddwch is provided with several items of specialist equipment for guest use. When making a booking, we ask all guests to make themselves aware of the capabilities and limitations of each item as follows:

Ceiling Track Hoist

The overhead ceiling track hoist in Heddwch is an Astor OT200 as supplied by Astor Bannerman.
This makes transfer easier from bed to wheelchair/shower chair and links into the en-suite wet room directly above the WC.
The hoist is designed, manufactured and programmed to operate carrying loads up to the safe maximum working load of 200kg. (31.5stone) This weight must not be exceeded.
The OT200 ceiling hoist takes slings with loops, attached to a 2-point, 4 hook spreader bar. Guests are requested to provide their own sling to suit their own requirements.

Geberit Aquaclean Shower Toilet

The WC in the en-suite wet-room provides washing and drying functions. It features WhirlSpray shower technology, TurboFlush technology and warm air drying. The WC seat has a maximum load bearing of 150kg (23.5stone).

Opera Solo Comfort Plus Profiling Bed

The profiling bed is 3ft6in wide (105cm) and has an external length of 83.5in (212cm). The bed can be extended for taller guests by 20cm (8in). The bed lowers right down to the floor (11.0cm) to provide a safe sleeping height and can be raised up to carers’ waist level (73.5cm) for nursing on the bed, and any height in between. An auto-regression back rest and two-part leg rest ensure optimum comfort whilst telescopic split side rails help to prevent falls from the bed.

Opera Impulse Hybrid Mattress

The mattress on the profiling bed can vary in firmness as it can be used with or without an air pressure pump. Where needed, Llainfran Holidays can supply a pump for your use during your stay.
The mattress is suitable for users who are at a very high risk of developing a pressure sore. It incorporates special gel pads designed for pressure points on your feet.
The mattress on its own and without the pump is a medium firmness and provides a supporting surface for high-risk users. Airflow can be adjusted using the pump to alter the firmness of the mattress.

12. BREAKAGES & SPILLAGES

Guests are expected to treat the property with care and attention as they would their own home and will be liable for any loss or damage to contents regardless of whether it is the result of negligence or acts committed by
themselves or by guests.
If you notice something is missing or damaged, please let us know immediately so that appropriate action can be taken. If there has been any damage, spillage or breakages during your stay, we would be grateful if you
could report them promptly and prior to check out.
Llainfran Holidays reserve the right to carry out inventory and other checks prior to your departure and to carry out repairs or maintenance.
We accept that minor accidents will happen. However, if the damage is significant, the guest will be liable to pay for repair or replacement. This may be in excess of the £200 Damage deposit.
You are responsible for the actual cost of any breakage, spillage/spoiling or damage in or to the property, along with any repair or replacement costs that may result. In this definition, property includes the building, fixtures, fittings, and all furnishings of the cottage along with any ancillary buildings and
contents that you have access to during your stay.
Llainfran Holidays reserve the right to seek compensation for any damage discovered after departure.
Damage includes blockage of drains through inappropriate use.
Furniture may be moved to accommodate accessibility, but you are asked not to move beds or sofas from one room to another without prior approval from us.
All items listed on the inventory must not be removed from the property.

13. PETS

We welcome an assistance dog or one well behaved and well-trained companion dog within Heddwch at no extra charge. Maximum of one dog unless otherwise previously agreed with us. Dogs are not allowed on any furniture or bedding and must not be left unattended, at any time. Owners must bring their own dog bed and bedding.
Please note the front garden is unenclosed and dogs are not permitted to run off leash in the front garden.
Dogs are not permitted to urinate or defecate on the deck or paved areas of the garden. The rear garden is enclosed, and dogs are permitted to run off leash provided they are supervised and watched. Please pick up all dog poo arising from your dog within the garden areas and deposit tied poo bags in the green bin provided in the rear garden.
We reserve the right to charge for any damage or for extra cleaning required.

14. ITEMS INCLUDED IN THE RENTAL

The following items are provided at Heddwch.
Quality bed linen, duvets and towels.
Heating and electricity.
Toiletries are available in each bathroom.
A welcome pack including tea, coffee, sugar, our own free-range eggs and local organic Welsh milk is provided.
We also provide a small supply of dishwasher tablets, washing up liquid and all the basic cleaning items that you would require during your stay.
Your property is fully serviced before your arrival.
Please contact us prior to your arrival if you have any special requirements / needs.
A travel cot is available. Please note that cot linen is not provided.

15. PERSONAL INJURY & LOSS OF PROPERTY

Llainfran Holidays do not accept any liability for accident, injury, loss or damage sustained by any member of the party, their family, visitors, vehicles or personal effects or cash however caused.

16. LIABILITY

We shall have no liability for any death or personal injury. You must take all necessary steps to safeguard yourself and your personal property for the duration of your stay at Heddwch.
We strongly advise that you take out your own personal travel and accident insurance. Please note we are in a rural environment, where some surfaces can be uneven and slippery, particularly following rain or cold weather.
Extra care will be needed at night-time.

17. CIRCUMSTANCES BEYOND OUR CONTROL

If for any reason the property has been rendered unsuitable for holiday let (e.g., water/fire damage, breakdown of heating system etc) on the date booked, we will endeavour to offer alternative dates, or a refund of all monies paid. No further claim can be made against Llainfran Holidays.
Llainfran Holidays cannot be held liable for a breakdown of any facilities which is beyond their reasonable control (e.g., breakdown or failure of any electrical equipment, facility or plumbing) or from negligence as a result of your misuse of the equipment.

18. OUR RIGHT TO EVICT

Llainfran Holidays may terminate the contract and ask you to leave the property immediately without any compensation being payable if:
(a) We consider that you or your party has committed a serious breach of these terms and conditions;
(b) if any complaints of anti-social or unacceptable behaviour have been made against you or your party;
(c) if you or your party cause an unreasonable amount of damage to the property or its contents;
(d) if you exceed the maximum occupancy limit for the property or stay after the agreed date of departure.

19. COMPLAINTS

We have made every effort to ensure that your holiday is enjoyable and trouble free. If you do have a complaint or problem, please inform us immediately, so that we may be given the opportunity to rectify and correct the situation as soon as possible. Any complaints or problems encountered during your stay, and not reported at the time, will not be considered later.

20. COMMUNICATING WITH YOU (DATA PROTECTION)

For the purposes of the Data Protection Act 1998, we are the sole data controller of all personal details provided to us by customers and prospective customers. To process your booking, we need to collect certain personal data from you. By accepting these terms and conditions you consent to receiving these communications from Llainfran Holidays in relation to your booking.
We guarantee not to pass these details on to third parties, but may store your details for our own administration, such as future marketing.
If you specifically do not want to be contacted again after your holiday, please notify us, and we will amend our records accordingly.

21. WEBSITE AND BROCHURE DETAILS

We have made every effort to ensure that the details contained on our website and other listings are accurate, however errors occasionally occur. You must therefore ensure you check all details of your arrangements with us at the time of booking.
We have a rolling programme of maintenance and improvements carried out throughout the year, but if any changes occur which alter your holiday, we will notify you.

22. GOVERNING LAW AND JURISDICTION

Any dispute under this agreement shall be interpreted in accordance with law of England, and any dispute shall be referred to the exclusive jurisdiction of the English Courts.
We reserve the right to make reasonable amendments or additions to these terms and conditions without notice.

23. RECOMMENDATIONS

If you have any recommendations for the improvement of any aspect of Heddwch please do not hesitate to contact us.
Our aim is the continued improvement of the facility based on the personal experience of our guests. We do hope you enjoy your stay and we look forward to welcoming you again in the future.
